Parole in place for Undocumented Spouses of US citizens – when to file

The US Citizenship and Immigration Service (USCIS) has recently announced that it will begin accepting Parole In Place applications for undocumented spouses of US citizens on August 19, 2024. This new immigration program will help certain undocumented spouses and children of US citizens apply for permanent residency (green cards) without leaving the US.

What You Can Do Now to Prepare for the Parole in Place program

You can begin to prepare for the parole in place program by gathering documents to show your eligibility. Useful documents to gather include:

Proof of a legally valid marriage to a U.S. citizen as of June 17, 2024

Evidence of your spouse’s U.S. citizenship

Documentation to establish your continued presence in the United States for at least 10 years.

Parole in Place Documents to Gather Now for your Child

Proof of the child’s relationship to the noncitizen parent

Evidence of the noncitizen parent’s legally valid marriage to a U.S. citizen as of June 17, 2024

Documents to show that the child has been living in the US in the United States as of June 17, 2024.

Parole In Place Information to Be Released by August 19, 2024

  1. The amount of the USCIS filing fees
  2. The immigration filing forms and instructions
  3. Biometrics process and fees to check for criminal history
  4. Whether interviews will be required.
  5. The mailing address for the application.

Please note that the USCIS will not accept applications under this parole in place program before August 19, 2024. If you apply before that date, they will reject your application.

Another thing you can do to prepare for the parole in place program is to speak to an immigration lawyer. Well prepared applications get approved faster, and your lawyer can help you with this. Also, if you currently have an immigration application pending, please do not abandon it at this time.

Finally, always get legal advice if you have made a false claim to US citizenship, voted in elections, have criminal convictions, drug related arrests, immigration violations or have filed previous immigration applications. Do not think that the USCIS will not find out. They will and it can cause serious problems if you do not get legal help early.
